Hara Terms of Service
These Terms of Service (Terms) govern the Hara app, website, AI assistant, and Hara Care portal and related services (Service), operated by Opusflame Limited (Hara, we, us). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Separate written organization agreements may apply to Hara Care.
Hara's automated features provide information for personal tracking, education, and discussion with qualified professionals. They do not provide medical advice, diagnosis, treatment, emergency monitoring, or a guarantee that a food is safe. Do not delay medical care because of an output or the absence of a warning. In an emergency, contact your local emergency services.
1. What Hara provides
Depending on the features available to you, Hara supports food and menu analysis; meal and reaction logging; bowel movement counts and times; health check-ins; symptom patterns and statistics; an AI assistant; summaries, reports, and suggested next steps; food preferences and assistant memory; recipes and meal ideas; reminders; and optional sharing with a care professional through Hara Care.
The Service organizes information you supply and may generate estimates and inferences from it. A symptom-tolerance score (including older labels such as Safety Score), impact level, trigger finding, health summary, or suggested seven-day plan is not a medical finding or prescribed treatment. Logged calm, mild, or active symptoms do not establish clinical remission, an IBD flare, inflammation, or disease progression.
2. Eligibility and accounts
The Service is intended for adults. You must be at least 18 and able to enter into a binding agreement where you live. Do not use the Service on behalf of a child or submit a child's health records. Some features may be unavailable in your region.
Account-based features require an account. Sign-in options may include Apple, Google, and email. Keep your account information accurate, safeguard your credentials, and contact us about suspected unauthorized access. Different sign-in methods may create separate accounts unless they are linked. App Store purchases remain subject to the store's account and restoration rules.
3. Permission to use the Service
We give you a limited, non-exclusive, non-transferable permission to use the Service for your own purposes in accordance with these Terms. Authorized Hara Care professionals may use the portal for its permitted record-sharing and communication functions within their authorized role and any applicable organization agreement.
Do not unlawfully access another person's information, impersonate a professional, bypass sharing permissions or security controls, misuse exports, introduce malicious code, overload the Service, or scrape data without authorization. Restrictions on reverse engineering apply only to the extent permitted by law. Do not use automated outputs to make autonomous medical, insurance, employment, or other consequential decisions about a person.
4. Your content, records, and assistant actions
You retain your rights in the information and content you submit. You give Hara permission to host, process, reproduce, and transmit that content as reasonably needed to provide the features you request, subject to the Privacy Policy and applicable permissions. This permission does not authorize selling your health records or using them for advertising.
Only submit information you have the right to provide. Avoid including other people's personal information in photos, messages, or documents. Food photos, voice transcriptions, menus, and user-entered records can be incomplete or inaccurate. Check quantities, ingredients, dates, times, symptoms, and other details before relying on a result.
When you ask the assistant to create or change a record, it may interpret your message and carry out supported actions. Review the saved result and correct mistakes using the available controls or contact support. Deleting or correcting a source entry may not revise every previously generated summary, saved memory, report, or exported copy. Ask us to help correct or delete associated information where needed.
5. AI processing, personalization, and memory
AI features use third-party services, including Google Gemini API and OpenAI API, as described in the Privacy Policy and the AI processing notice. Accepting these Terms alone is not permission to send health information to an AI provider. AI processing requires a separate affirmative permission. Care sharing and device permissions are also distinct choices.
Depending on the requested feature, the assistant may use your current messages and photos, relevant conversation history, health profile, food and symptom records, health check-ins, derived patterns, and saved preferences or memories. It may create and update summaries and memory in the background to support later conversations while AI processing is enabled.
AI can misunderstand inputs, omit relevant information, invent details, or produce inconsistent results. A reference or explanation does not establish that an output has been clinically reviewed. Associations between foods and symptoms do not prove causation. Scores and summaries depend on the records available, the selected period, and the model and may change after corrections or updates. Missing records do not establish that no symptoms occurred.
You may decline AI processing or withdraw permission in account settings. AI features will then be unavailable until permission is granted again. Withdrawal does not recall information already processed or delete existing records by itself; see the Privacy Policy for deletion requests.
6. Food, recipes, and external sources
Recipes and meal ideas may come from Hara's curated library, AI-generated content, or web search. A label such as IBD-friendly, IBS-friendly, or low-FODMAP does not mean a meal is appropriate for everyone with that condition. Nutrition values and serving estimates may be approximate.
Hara cannot verify allergens, hidden ingredients, cross-contact, preparation, storage, or food handling. Confirm ingredients with manufacturers or restaurants and follow your clinician's advice. Do not begin restrictive diets, change medication, or substitute a suggested plan for professional care based only on Hara.
External websites and linked resources have their own terms and privacy practices. Inclusion of a link or a reference to a health organization does not imply endorsement, affiliation, or verification of every statement. Third-party material remains subject to its owners' rights.
7. Hara Care: sharing and professional responsibilities
Hara Care is currently a limited internal beta for invited testers. It is not offered for clinical care or emergency use, and its features may change or be unavailable. Use synthetic or appropriately de-identified records for internal testing. Any move to real patient use requires a separately authorized arrangement, the necessary privacy and professional safeguards, and any required agreements before that use begins.
Hara Care lets you connect with a particular professional and share records. Before connecting, check the person's identity and organization. A connection may allow access to existing and future food logs and reactions, your health profile and check-ins, related statistics and summaries, exports, and care messages, as described in the connection notice and sharing settings.
You can change sharing permissions or disconnect a professional in Hara. Disconnecting ends future access through that connection; it cannot recall files already downloaded or records a professional must retain independently. Applicable privacy and deletion rights still apply to those recipients. Your own exports and shares may contain sensitive health information; choose recipients and storage locations carefully.
Hara provides the software platform. Connecting does not by itself establish a professional-patient relationship, verify licensure or suitability, provide a medical consultation, or guarantee that someone will review your records. Any professional relationship, scope of care, response expectations, and fees must be agreed with the professional. Professionals remain responsible for their own advice, credentials, recordkeeping, and legal obligations.
Care messages, read indicators, notifications, and dashboard findings are not emergency monitoring or guaranteed delivery, review, or response. AI-generated summaries are distinct from a professional's own assessment and must be checked against source records. They are not a validated clinical decision system. Use of AI in a professional workflow must comply with the applicable provider's restrictions and any required written agreements; human review does not waive those restrictions.
Professionals must access only information they are authorized to see, use it only for the permitted purpose, protect downloaded copies, respect changed permissions, and not disclose it beyond the user's authorization or applicable law. Neither these Terms nor a user's connection request is a HIPAA business associate agreement or a substitute for any required data processing agreement. Where such an agreement is required, the relevant processing must not begin without it.
8. Subscriptions, trials, and cancellation
Paid features, billing periods, prices, trial conditions, and renewal terms are shown before purchase. For subscriptions purchased through Apple, Apple processes payment and Hara receives transaction and entitlement information, not your full payment card details.
Auto-renewing subscriptions continue unless canceled through the applicable store settings before renewal. A free or discounted trial may convert to the disclosed paid subscription unless canceled in time. On Apple platforms, cancel at least 24 hours before a trial or current period ends to avoid the next charge. You can manage subscriptions through your Apple account settings and request eligible refunds through Apple. Mandatory consumer rights remain available.
Deleting Hara, deleting your Hara account, withdrawing AI permission, or disconnecting a professional does not automatically cancel an App Store subscription. Cancel the subscription separately. Restore Purchases can restore eligible purchases using the same store account. We will give any notice or obtain any agreement legally required for changes to paid terms.
9. Privacy, notifications, and third parties
Our Privacy Policy explains collection, AI recipients, health data, Care sharing, retention, and your rights: https://harahealth.app/privacy. It is a notice of our practices, not a blanket consent to optional processing. Where separate consent is required, accepting these Terms is not a substitute.
Notifications, camera, photos, microphone, speech recognition, and tracking permissions can be controlled in your device settings. Some functions need the relevant permission. Reminders may be delayed or fail and should not be relied on for urgent medical needs. Your device's notification previews may be visible to other people.
We use external hosting, authentication, AI, subscription, and delivery services. Their availability may affect features. Third-party terms do not remove Hara's responsibilities under applicable law.
10. Suspension, closure, and changes
You may stop using the Service and request account deletion at any time. We may restrict access where reasonably necessary to address misuse, security risks, legal requirements, or material breaches of these Terms. Where appropriate, we will explain the restriction and provide a way to contact us. Your statutory rights and valid refund rights are not waived.
We may change the Service or these Terms. We will identify the updated date and provide appropriate notice of material changes before they take effect where required. If a change needs your affirmative agreement or a new data-processing permission, continued use alone will not supply that agreement or permission. Any change remains subject to mandatory consumer law and existing paid commitments.
11. Warranties and liability
Subject to your non-excludable rights, the Service is provided as available, and we do not promise uninterrupted access or that every automated output is accurate, complete, or suitable for you. We remain responsible for obligations that applicable law does not allow us to exclude.
To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable. To that same extent, our aggregate liability arising from the Service is limited to the fees you paid for the Service, including through an app store, during the 12 months before the event giving rise to the claim.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, statutory data-protection liability, or any other liability to the extent it cannot lawfully be limited. Nothing here excludes mandatory warranties, remedies, or consumer rights. You are not required to indemnify Hara for its own wrongdoing.
12. Contact and resolving concerns
Contact Opusflame Limited at info@harahealth.app or visit https://harahealth.app. Please describe the issue without sending unnecessary sensitive health information. We will work with you to address it. You retain the right to contact a regulator and to bring a claim in a court with jurisdiction under applicable law. These Terms do not impose mandatory arbitration or waive class-action rights.
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A separate written agreement controls the subjects it expressly covers, without reducing non-excludable individual rights.
